2. Collection and storage of personal data as well as the type and purpose of use

a) When visiting the website

When you visit our website at www.weingut-neiss.de, your device’s browser automatically sends information to the server for our website. This data is temporarily stored in a so-called log file.

The following data will be collected without your intervention and stored until automated deletion:

  • IP address of the requesting computer,
  • Data and time of access,
  • Name and URL of the requested file,
  • Website from which the request has originated,
  • Browser type and version and your computer’s operating system and name of your service provider


We process the above-mentioned data for the following purposes:

  • to ensure smooth connection of the website,
  • to ensure convenient usage of our website,
  • to evaluate system security and stability, and
  • for further administrative purposes.

b) When subscribing to our email

With your express consent under Article 6 para. 1(1a) GDPR, we will use your email address to regularly send you our newsletter. The simple provision of your email address is sufficient consent to receive the newsletter. You may unsubscribe at any time, e.g., by using the link at the end of each newsletter. Alternatively, you may submit your request to unsubscribe by email to info@weingut-neiss.de at any time.



c) When using the contact form

If you have any questions, you can contact us using our website’s contact form. It is necessary that you provide a valid email address so that we know who is sending the query and so that we can reply. Any further information is provided on a voluntary basis.

The data you disclose will be saved and processed by us in accordance with Article 6 para. 1(1a) GDPR on the basis of your voluntary consent to process your inquiry.

Any personal data that we collect in relation to the contact form will be deleted by us automatically once the reason for the query has been resolved.




3. Disclosure of Information

We never disclose your personal information to third parties except for the explicit purposes listed below.

We share your data to third parties only if:

  • you have given your express consent in accordance with Article 6 para. 1 (1a) GDPR,
  • the disclosure in accordance with Article 6 para. 1 (1f) GDPR is required in order to establish, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that a legal obligation for disclosure exists in accordance with Article 6 para. 1 (1c) GDPR and
  • this is legally permissible and required for processing contractual relationships with you in accordance with Article 6 para. 1 (1b) GDPR.



4. Cookies

We use cookies on our site. These are small files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device, nor do they contain viruses, Trojans or other malicious software.

Each cookie contains information reflecting the connection to a specific terminal device. This does not, however, mean that we are able to directly identify you personally.

5. Analytical Tools

a) Tracking Tools

The tracking measures listed below and used by us are implemented in accordance with Article 6 para. 1 (1f) GDPR. We employ tracking measures on the one hand to ensure that our website is appropriately designed and to aid in making ongoing improvements. On the other hand, we also use tracking measures to capture statistics on the use of our website, which are then used to improve the site. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories are indicated in relation to the specific tracking tools.


i) Google Analytics

To promote an appropriate design and continuous optimization of our website, we use Google Analytics, a web analytics service from Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). Pseudonymized usage profiles are generated and so-called cookies (see item 4) are used in this context. The data collected by the cookie about your use of the website such as

  • operating system,
  • referrer URL (the previously visited page),
  • host name of the accessing computer (IP address),
  • time of the server request,

is then transferred to a Google server in the USA and stored there. The data is used to evaluate usage of the website, to compile reports on website activities and to provide further services associated with use of the website and the Internet for the purposes of market research and adequate design of these Internet pages. This data may also be shared with third parties if required by law or if third parties are commissioned to process such data. Under no circumstances do we combine your IP address with other Google data. The IP addresses are anonymized to make any such personal identification impossible (IP masking).

ii) Google Adwords Conversion Tracking

To statistically record the use of our website and for the purpose of optimizing our website, we also use Google Adwords Conversion Tracking. Google Adwords places a cookie (see Section 4) on your computer if you have accessed our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, then Google and the Adwords customer can detect that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Thus cookies cannot be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers see the total number of users who clicked on their ad and were redirected to a page with a conversation tracking tag. However, they do not receive any information that personally identifies users.

If you do not wish to participate in the tracking process, then you can refuse placement of the cookie required for this purpose – for example, by using a browser setting that generally deactivates automatic placement of cookies. You can also deactivate cookies for conversation tracking by setting our browser to block cookies from the “www.googleadservices.com” domain. iii) Matomo

We use an open source web analysis tool called Matomo for the analysis and statistical evaluation of the use of our website. This requires the use of cookies (see Section 4). These data are transferred to our server and can be used to create pseudonymized usage profiles. This information is used to optimize our website based on the needs of its users. This information will not be shared with third parties.

Under no circumstances do we combine your IP address with other personal data. IP addresses are anonymized to make personal identification impossible (IP masking).

6. Social Media Plug-ins

Our website uses social media plug-ins from the social media networks Facebook, Twitter and Instagram. This is done in accordance with Art. 6 Section 1 (1f) GDPR, with the aim of publicizing our company. This qualifies as a justified interest in the sense of the GDPR. Responsibility for operations in compliance with data protections is guaranteed by the respective providers. We have implemented these plug-ins using a so-called two click method to provide the best possible protection for users to our website.



a) Facebook

Our website uses social media plug-ins from Facebook to allow for a more customizable user experience. In particular, we use the “LIKE” and “SHARE” buttons. These are services offered by Facebook.

If you call up a page in our web site containing a plug-in of this type, then your browser establishes a direct link to Facebook’s servers. The content of the plug-in is transferred from Facebook directly to your browser and integrated by Facebook into the website.

Through this integrated plug-in, Facebook receives information that your browser has called up the relevant page of our website, even if you do not have a Facebook account or are not currently logged into Facebook. This information (including your IP address) are sent by your browser directly to a Facebook server in the USA, where it is saved.

If you are logged into Facebook, then Facebook can directly associate your visit to our website with your Facebook account. If you interact with the plug-ins, such as by clicking on the “LIKE” or “SHARE” button, then corresponding information is transmitted directly to a Facebook server, where it is also stored. The information is also published on Facebook and displayed to your Facebook friends.

Facebook can use this information for advertising, marketing research and user-specific design of the Facebook pages. This includes the creation by Facebook of usage, interest and relationship profiles, such as on your use of our website with reference to the ads that Facebook displayed to you, informing other Facebook users about your activities on our website and on the provision of services connected to Facebook.

b) Twitter

Our internet pages feature integrated plug-ins from the social media network Twitter Inc. (Twitter). The Twitter plug-ins (tweet button) can be recognized by the Twitter logo on our page. An overview of tweet buttons can be found here.

When you visit a page on our website that contains one of these plug-ins, a direct connection between your browser and the Twitter server is established. In the process, Twitter receives the information that you have visited our page with your IP address. If you click on Twitter’s “tweet button” while logged into your Twitter account, then you can link the content of our pages to your Twitter profile. In this way, Twitter can associate your visit to our pages with your Twitter user account. 8. Right to Object

If your personal data is processed on the basis of legitimate interests in accordance with Article 6 para. 1 (1f) GDPR, then you have the right to object to the processing of your personal data pursuant to Article 21 of the EU General Data Protection Regulation (GDPR), provided that there are grounds relating to your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection, which we will implement without specification of a particular situation.

9. Data Security

We use the widely employed SSL procedure (Secure Socket Layer) in connection with the respectively highest level of encryption supported by your browser within the scope of the website visit. Usually this is 256-bit encryption. If your browser does not support 256-bit encryption, then we use 128-bit v3 technology instead. Whether any given page of our website has been transmitted in encrypted form is indicated by the display of the closed key or lock symbol in the lower status bar of your browser.

We also use suitable technical and organizational security measures in order to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in accordance with technological developments.
